Ownership of videos

All videos recorded are owned by SantaVM. The fee that you the customer pays to request a video is a licence to view and share that video, the ownership belongs to SantaVM. No one can sell or profit from any videos without the express agreement and permission of SantaVM.

For customers who order videos (notice shown before check-out)

You may have to be patient (There is no guaranteed completion date).

SantaVM may not include all the info that you provide.

The length of the videos vary.

The video will be smartphone or 24.1MP APS-C digital camera quality.

SantaVM may pronounce names wrong/make other mistakes.

Expected Waiting Time

Up to 72 hrs, however this cannot be guaranteed due to SantaVM’s individual schedule and changing circumstances. You can cancel your request at any time for a full refund if you need it for a specific date or for any other reason.

1. You may have to be patient

Most videos are done within a few hours to a few days. SantaVM gets daily reminders of his requests. However, due to his busy schedule he may not be able to record as often as he had planned. If you are patient, you should get your video within a reasonable timeframe. If you cannot wait, then you can cancel for a full refund at any time.

2. SantaVM may not include all the information that you provide

He will pick and choose what to say based how he thinks he can make the most interesting video for you.

3. The length of the videos varies

Sometimes a video may be around 90 seconds long, sometimes even up to 5 minutes. This will depend upon the information given and how SantaVM thinks he can do the most interesting video.

4. The video quality will be smartphone or 24.1MP APS-C digital camera.

Santa will record videos using his phone or 24.1MP APS-C digital camera so the quality will depend on the device that he uses and the internet connection he has at the time.

5. SantaVM may pronounce some names wrong/make other mistakes.

He will work off of the information given to him. Please fill out the phonetic spelling on the form if your child’s name is not very common to avoid mispronunciation. SantaVM may on occasion be able to re-record a video depending on the mistake.

Video Ownership

You can enjoy and share your video but cannot profit from it without the express permission and agreement from SantaVM. When you pay to request a video, you are paying for a licence to watch and share the video. The ownership of the video remains with SantaVM.

Payments and Emails

1. Customers will use a valid email address to place their order which we can use to contact them if needed
2. Customers will only use valid payment methods that belong to them. If the card they are using to place the order does not belong to them then they will have gained the cardholder’s permission before making the order.
3. Introduction

Terms of Service Agreement between SantaVM and users (‘You/Your’) of the SantaVM.com (‘website’). Your use of the website is subject to the following legally binding terms of service. Please read them carefully before entering the website. You cannot enter this website if you do not accept these Terms of Service.

In no event will SantaVM be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to SantaVM under this agreement during the twelve (12) month period prior to the cause of action. SantaVM shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

6. Indemnification.

You agree to indemnify and hold harmless SantaVM, from and against any and all claims and expenses, including attorney’s fees, arising out of your use of the Website, including but not limited to your violation of this Terms of Service.

7. Termination

SantaVM reserves the right to cease providing services at any time.

SantaVM shall not be liable to you for any cost, expense, or damages whatsoever for terminating this Agreement.

8. Governing law

These Terms of Service will be governed by and construed in accordance with English Law.

9. Definitions

“Agreement” means the Terms of Service that apply to the use of the website which may be amended from time to time.

“SantaVM” means SantaVM.com

“Website” means internet website with the URL www.SantaVM.com

“You” means the user of the Website (and “Your” has the corresponding meaning).

How SantaVM works

You can request a video message for a personal connection, Christmas, shout-out, proposal, surprise or as a gift for a birthday, wedding, congratulations and much more.

1. Enter the details that you want them to mention (E.g. Name/s, achievements, what they want for Christmas, Birthday, Hobbies etc).
2. Pay safely and securely with PayPal.
3. You will receive an email with your download link as soon as SantaVM has recorded your video.

** Most videos are recorded within a few days.

** If you need a video for a specific date, you can cancel your request at any time for a full refund.

** Santa records videos as and when he can on his smartphone or 24.1MP APS-C digital camera.

Why should you use SantaVM?

You can use SantaVM to raise money and awareness for their charities and causes

**SantaVM prices are for personal use videos, so if you request a video to promote a business or product the SantaVM will likely ask for a higher fee for a video

**SantaVM can cancel any requests that he does not want to do or does not have time to do
